     1. INTRODUCTION
TotalSoft is committed to the protection of your personal data and respects your privacy on all websites it owns and manages.
This privacy policy on the protection of natural persons with regard to the processing of personal data by TotalSoft complies with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
This privacy policy covers all TotalSoft websites.
You can browse these sites without providing any personal data. However, in situations such as: to respond to a request/complaint from you or to consider your application for one of the jobs available within TotalSoft SA, you may be asked or required to transmit to us, in certain cases, information that falls under the category of personal data, this information being provided voluntarily by you.
This privacy policy applies to personal data collected by the sites managed by TotalSoft, and for this data you will find more detailed information below.
     2. GENERAL INFORMATION
TotalSoft S.A. is a Romanian legal entity registered at ORC Bucuresti under no. J23/3370/2016, with tax ID RO 36438401. The contact address is Șos. București Nord 10, Global City Business Park, building O21, floors 6, 7, and 8, Voluntari, Ilfov, Romania.
As a data controller, TotalSoft SA is responsible for the processing of personal data of individuals who access/use the company's websites and will give proper consideration to the protection of your personal data when you access the websites it manages.
The website www.charismahr.com offers its visitors, through its sections and subsections, information about: the company, the solutions and services offered, the jobs available within TotalSoft, the company's client portfolio and their references, announcements and any other relevant news or information regarding the company's activity. 
The website also allows its visitors to use specific forms to contact a company representative or to express their intention to be part of the TotalSoft team.
The Privacy Policy on the Protection of Individuals with regard to the Processing of Personal Data (“Policy”) describes the ways in which we, TotalSoft SA, collect and process personal data that you voluntarily provide to us when you use our websites. 
This policy provides information on: the types of personal data that may be collected through our websites, how we process the personal data provided by visitors to our websites, to whom personal data may be transmitted, and the rights and options that individuals have regarding the protection of their personal data. This policy also describes the measures we take to ensure the security of information and how you can contact us regarding the implementation of data protection and to exercise your rights.
     3. CATEGORIES OF PERSONAL DATA PROCESSED
As stated above, a visitor or existing customer of TotalSoft can use our sites without having to disclose any personal data to the company. 
However, if a visitor or existing customer of TotalSoft wishes to contact us, in certain situations such as those presented below, it is necessary to provide the following data:
        A. Website http://www.charismahr.com:
   1. For contacting and/or submitting requests or complaints to TotalSoft regarding the solutions and services offered by the company, using the "Contact" form available in the "Contact" section, the personal data that will be processed are: the applicant's name and surname, telephone number and email address, the subject of the request and the information contained in the message sent in this regard.
   2. To contact TotalSoft, in order to become a partner of the company, by completing the form in the "Partners/Become a Partner" section (partner.totalsoft.ro), the data that will be processed are: the applicant's name and surname, phone number and email address, position held within the company, company name, information contained in the message sent in this regard.
It is recommended that the messages you send us through the forms specified in points 1 and 2 do not contain (other) personal data besides those requested through the forms made available by our company. In the event that they are necessary, they will be requested later, when we contact you, in order to resolve the issues for which you contacted us. 
Any personal data sent to us that are not necessary for the purpose for which they were disclosed will be deleted/anonymized after transmission.
   3. To apply for one of the vacant positions within our company and displayed as such on our website, by completing the form in the “Careers/Contact” section (cariere.totalsoft.ro), the personal data that will be processed are: the applicant’s name, telephone number, as well as those contained in the Curriculum Vitae that you attach.
The personal data in your CV or other information you provide to us in this context may include, but is not limited to, the following: full name, home address/residence/mailing address, e-mail address, telephone number, photo, previous employers, job responsibilities, holding a work permit, professional authorizations and certifications, professional achievements, previous projects, recommendations, analyses of professional development and skills, training, details related to performance and adaptation to professional requirements, any other information you choose to make available to us (e.g. preferred positions, availability for relocation, current salary, desired salary, awards received or membership in various professional associations).
We will use your personal data in the recruitment process for the available position for which you have expressed your interest, as well as for any other positions that become vacant and for which we consider you eligible for a period of 2 years. In this regard, we will keep your CV in TotalSoft records for a period of 2 years. After this period, your CV will be deleted from our records.
 
Any personal data sent to us that are not necessary for the purpose for which they were disclosed will be deleted/anonymized after transmission.
For your information and to the extent that TotalSoft considers it of interest, it is possible that the sites that are the property of the company may include other links/addresses to websites that TotalSoft does not control. These websites operate independently of our sites and may have their own notification, statements or privacy policies. We recommend that you analyze the policies regarding the protection of personal data before sending any personal information to these websites. TotalSoft SA is not responsible for the content of websites that do not belong to it or that it does not manage.
 TotalSoft automatically collects certain technical information about visitors/users of the site and stores it in log files or other similar technologies. This is statistical data regarding the actions and browsing patterns of our users and does not “directly” identify a specific person. This data includes: the region or geographic location from which your computer or device accesses the Internet, browser type, operating system and other information about visiting websites, including a history of the pages you view. This information is used to better design our sites in accordance with the needs of users. Your IP address will also be used to diagnose problems with our server, to administer this site, to analyze trends, to track a user’s navigation on the site, to collect demographic information and to help us understand visitor preferences and needs.

      4.    PURPOSE AND LEGAL BASIS FOR PROCESSING
The information you provide us is treated with the utmost confidentiality and exclusively for the purposes for which it was collected.
TotalSoft processes personal data through the websites for the following purposes:
   1. Resolving requests and complaints received from TotalSoft visitors and/or customers;
   2. Managing the relationship with users/visitors, respectively the support offered to them through the contact forms existing in various sections of the websites;
   3. Improving the browsing experience offered on the website;
   4. To protect against fraud and other illegal activities;
TotalSoft processes personal data for the above purposes in its legitimate interest to manage the relationship with its visitors and/or customers who access the websites, to avoid fraud and illegal activities and to ensure the general functionality of the websites, according to the provisions of point f) of Article 6(1) of Regulation (EU) 2016/679.
   5. Registration and processing of applicants' applications for available jobs displayed on the company's website.
TotalSoft processes personal data for the above purposes in its legitimate interest to ensure the workforce necessary to carry out its activity.
      5.    DATA RETENTION PERIOD
TotalSoft processes personal data only for the period necessary to fulfill the above-mentioned processing purposes, while respecting the legal requirements in force and the interest of protecting the rights of the data subjects.
More specifically, we do not keep your personal data longer than necessary, but only for a period long enough to fulfill the purpose for which we collected them in accordance with the applicable legal provisions. As soon as we no longer need them, we initiate actions to delete or destroy them, unless the law requires us to keep them for a longer period of time.
Unless otherwise stated in this document, in accordance with the provisions of the Civil Code regarding the legal institution of prescription, the collected personal data are archived/stored by TotalSoft for a period of 3 years.
      6.    TRANSMISSION/DISCLOSURE OF PERSONAL DATA
The collected personal data are disclosed only to authorized persons, according to the technical and organizational procedures assumed and established by TotalSoft, which are adequate and necessary to maintain the confidentiality of personal data, to protect against accidental or unlawful destruction, loss, disclosure or unauthorized access, according to the law.
In order to fulfill the processing purposes, TotalSoft may indirectly disclose your personal data to partners, to third parties or entities that support the company's activity through websites, audit firms, consultants, resellers, shareholders or other companies in the Logo group of which TotalSoft is a part or to the extent that we are obliged to do so by law, at the request of tax authorities or other competent control authorities.
Personal data may be transferred to countries outside the European Union. If a transfer outside the European Union is considered, we will ensure that it will be made to a country that benefits from an appropriate decision issued by the European Commission or, alternatively, on the basis of approved standard contractual clauses.
Personal data collected by Cookies are not directly transferred by Total Soft SA outside the European Economic Area. However, certain collaborators or suppliers (e.g. Google Ireland Limited, Facebook Ireland Limited etc.) may transfer data that they collect directly through Cookies from the websites on which Total Soft SA operates outside the European Economic Area.
     7.    YOUR RIGHTS UNDER GDPR
According to the General Data Protection Regulation, as a data subject you have the following rights:
  • Right to information: the right to receive information about the personal data processing activities carried out by TotalSoft;
  • Right of access: the right to obtain from TotalSoft confirmation as to whether or not your personal data is being processed, as well as information about how these data are being processed;
  • Right to rectification: the right to ask TotalSoft to correct your data when your data in our possession and processed by us is incomplete, inaccurate or has changed since the date of collection;
  • Right to erasure ("right to be forgotten"): the right to ask TotalSoft to erase your personal data if it is no longer necessary for TotalSoft to keep or use them or if the data has been processed unlawfully;
  • Right to restriction of processing: the right to request and TotalSoft to restrict the processing of your data when you consider that it is inaccurate, you consider that the processing of your data is not lawful or you want us to keep your personal data beyond the minimum retention period required by TotalSoft;
  • Right to data portability: the right to receive the data we have collected from you and processed automatically, following your consent, in a structured, user-friendly format or to transmit your data to another data controller, if this is technically feasible;
  • Right to object: the right to object to the processing of your data based on the legitimate interest of TotalSoft when you consider that this processing harms your interests, rights and freedoms or when the processing of your data is for the purpose of direct marketing;
  • The right not to be subject to a decision based solely on automated processing, including profiling: the right not to be subject to a decision based solely on automated processing, without human intervention, including profiling, and which affects your interests, rights and freedoms;
  • The right to lodge a complaint with the Autorității Naționale de Supraveghere a Prelucrării Datelor cu Caracter Personal (ANSPDCP) if you consider that your data has not been processed in accordance with the legal provisions.

      8.    DATA SECURITY
TotalSoft implements administrative, technical, organizational and physical security measures to protect your personal data against accidental, unlawful or unauthorized destruction, loss, alteration, access, communication or use for other purposes, including:
  • We update and test our security technology continuously. Our websites and related IT systems are protected against access, modification or transmission of your data by/to unauthorized third parties as well as against their loss and destruction;
  • We restrict access to your personal data only to those employees who need to know that information to provide you with services;
  • We train our employees on the importance of confidentiality in order to maintain the confidentiality and security of your information.
